Council Files Amicus Brief Supporting the Release of Individuals from Immigration Detention During the COVID-19 Pandemic

The American Immigration Council filed this amicus curiae brief in support of individuals who sought release from detention due to their significant risk of infection from COVID-19. After the district court ordered their release, the government appealed the decision to the Third Circuit Court of Appeals. Providing specific case examples, the Council’s brief argues that Immigration and Customs Enforcement (ICE) has a long-standing practice of releasing individuals who are subject to mandatory detention when medical concerns justify such release.
