Comments Filed To Address Substantive Flaws in Proposed H-1B Regulatory Changes

The American Immigration Council and the American Immigration Lawyers Association filed comments to address the substantive flaws in the Department of Homeland Security's proposed changes because of concern that DHS will try to move forward with the rules as issued. The rule was set aside by the federal district court in Chamber of Commerce of the United States v. Dep’t of Homeland Sec., No. 4-20-cv-07331-JSW, Dkt. 73 (N.D. Cal. Dec. 1, 2020), The comments urged DHS to neither reissue the rule nor finalize it based on comments the agency receives.
