Council Urges DHS to Establish a Functioning System of Discretionary Review from ICE Detention

The American Immigration Council and the American Immigration Lawyers Association (AILA) sent a letter to the U.S. Department of Homeland Security (DHS) regarding the need for functioning system of discretionary release within U.S. Customs and Immigration Enforcement (ICE), including:

  • An affirmative case review of all detained individuals.
  • The release of those who fall outside the current enforcement priorities.
  • Nationally consistent guidance on release eligibility.
  • An accessible procedure for requesting release.
  • Training on release eligibility for ICE officers.
  • National oversight.
